Abstract

This research is motivated by the gap between the learning of fiqh munakahat in Islamic boarding schools that are oriented towards religious norms and the needs of students to understand the national marriage law that regulates aspects of marriage age, registration, marriage dispensation, polygamy, rights and obligations of couples, and divorce. This research aims to analyze the relationship between fiqh munakahat and national marriage law and formulate its form of integration in learning for students of marriage age. The research uses a qualitative approach with the type of literature study. Data were obtained from laws and regulations, Compilation of Islamic Law, jurisprudence literature, books, and relevant journal articles, then analyzed through content analysis with stages of reduction, categorization, interpretation, and conclusion drawn. The results of the study show that the fiqh munakahat and the national marriage law have substantive suitability in the purpose of marriage, the position of guardians, the rights and obligations of the husband and wife, and family responsibilities, but there are gaps in the age limit of marriage, registration, marriage dispensation, polygamy, and divorce procedures. The novelty of the research lies in the placement of the gap as a pedagogical problem, not merely a difference in norms, so that the national marriage law is positioned as a contextual material in the learning of fiqh munakahat. Integration is formulated through four stages, namely basic mastery of fiqh, contextualization of national law, analysis of marriage issues, and religious-legal reflection. The research concludes that the pattern of integration can strengthen the legal awareness and readiness of students to face family life without eliminating the scientific character of the Islamic boarding school. The implications of this study emphasize the need to develop munakahat fiqh material that connects religious sources with Indonesian marriage regulations in a systematic manner, so that pesantren can form students who not only understand the validity of marriage according to fiqh, but are also able to consider family protection and legal certainty in national practice.
